By accessing or using the Contrack mobile application (referred to as "the App"), you agree to be bound by this Privacy Policy and Terms and Conditions, which govern your use of the App. If you disagree with any part of these terms, you may not access the App.

Your privacy is important to us. Please review this Privacy Policy to understand how we collect, use, and disclose information about you and the functionality of the Contrack App.
By using the App, you consent to the collection and use of your information in accordance with this Privacy Policy.
Netcorp GPS Pty Ltd (owner of the Contrack app) is an ISO9001 and ISO27001 certified company and stores data in accordance with international standard of data privacy and security policies.

Description of App

Contrack is a mobile application owned by Netcorp GPS Pty Ltd (ABN 45 153 814 987), designed to facilitate the GPS tracking of contractors using the app installed on their mobile phone and the management and tracking of their location so that it can send the information to Netcorp’s GPS tracking platform for a Netcorp customer. The main purpose of the app is to act as a direct replacement for an otherwise installed portable GPS tracking hardware device, without the logistical or technical requirement to do so. The Contrack App’s GPS tracking capability is only based on a user’s permission to allow this capability on their device, and it can be disabled by logging out of the application at any time. The GPS tracking capability is required as a background service as the constant location of the contractor is required for other third-party functionality including job management, automated geo-fence triggering, and customer package deliveries can be tracked even if the app user is utilizing other apps on their device.

User Accounts

In order to access certain features of the App, the user is required to create an account.
The account is required to be approved by an authorized representative of the company the contractor is working for.
App users are responsible for maintaining the confidentiality of their account and password and for restricting access to their device while the app is being used.
App users agree to accept responsibility for all activities whilst using the app and understand that this data is being sent to a third party for the purpose of job management and vehicle productivity.

User Conduct

You agree to use the App only for lawful purposes and in a manner consistent with all applicable laws and regulations.
You will not use the App in any way that could damage, disable, overburden, or impair the App.
You will not attempt to gain unauthorized access to any portion or feature of the App.

Intellectual Property

The App and its original content, features, and functionality are owned by Contrack and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the App without the prior written consent of Contrack.

Location Permission

The App requires access to your device's location to provide certain features and functionalities, such as location-based contract tracking.
In order for the app to function correctly, the Location Permission will continue to run in the background even if the app is closed, to enable you to use other apps without the service ceasing to send data to Netcorp’s GPS tracking platform.
Once you log off the app, it will stop sending GPS tracking data to Netcorp’s system.
By using the App, you consent to the collection and use of your device's location information in accordance with our Privacy Policy.

Third-Party Links

The Contrack App may contain links to third-party websites or services that are not owned or controlled by Contrack.
Contrack has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You further acknowledge and agree that Contrack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Disclaimer of Warranties

The App is provided for free download, on an "as is" and "as available" basis. Contrack makes no representations or warranties of any kind, express or implied, regarding the availability, accuracy, reliability, or content of the App.
To the fullest extent permitted by law, Contrack disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Contrack does not warrant that the App will be uninterrupted or error-free, or that defects will be corrected. Any reported issues are dealt with on a case-by-case basis and repaired on a best effort service level based on our commitment to ISO9001 quality assurance and keeping with standard software development practices.

Limitation of Liability

In no event shall Contrack, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any:

Errors, mistakes, or inaccuracies of content;
Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the App;
Any unauthorized access to or use of Contrack's secure servers and/or any and all personal information stored therein;
Any interruption or cessation of transmission to or from the App;
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.

Indemnification

You agree to defend, indemnify, and hold harmless Contrack, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the App;
Your violation of any term of these Terms and Conditions;
Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
Any claim that your use of the App caused damage to a third party.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
Any dispute arising out of or related to these Terms and Conditions or the use of the App shall be brought exclusively in the courts located in Australia, and you hereby consent to the jurisdiction and venue of such courts.

Changes to Terms and Conditions

Contrack reserves the right to modify or replace these Terms and Conditions at any time.
By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
